The samples and/or tools are being provided on an "as is" basis and as an accommodation to assist the recipient in their evaluation and assessment of feasibility of NXP products. All warranties, representations or guarantees of any kind (whether expressed or implied) including, without limitation, warranties of merchantability, non-infringement, or fitness for a particular purpose, are specifically disclaimed. The recipient assumes all risk associated with the use thereof and NXP assume no liability whatsoever. No license is to be conveyed by the transfer, and NXP shall not be liable for any damages, of any nature or kind, resulting from the use of these samples and/or tools.
